What Problem Was This Bill Trying to Solve?
Artificial intelligence is rapidly changing how information is created, shared, and consumed, including in political campaigns and elections. While these technologies provide new opportunities, they also create risks when used to produce deceptive content, impersonate candidates, or mislead voters.
Public confidence in elections depends on voters having access to accurate information and the ability to distinguish between authentic content and artificially generated material.
This legislation establishes safeguards to increase transparency around the use of artificial intelligence in political communications while protecting legitimate speech, journalism, and political expression.
What Does the Bill Do?
Requires disclosure when artificial intelligence-generated synthetic media is used in political advertisements intended to influence voters.
Requires AI-generated audio and video communications to include disclosures at the beginning and end of the communication indicating that synthetic media has been used.
Prohibits the distribution of materially deceptive audio or visual communications related to candidates or election administration within 90 days of an election.
Applies protections against deceptive communications involving:o False depictions of candidates intended to influence voters.o Misleading content about election procedures, voting requirements, election dates, certification, or endorsements.o Deceptive communications intended to disrupt the integrity of the electoral process.
Allows candidates whose voice or likeness is used in materially deceptive AI-generated content to seek legal remedies, including injunctive relief and damages.
Establishes penalties for violations of AI disclosure requirements in political advertising.
Provides exemptions for news organizations, reporting on political advertisements, websites, publications, and satire or parody.

Trust in our elections depends on voters having confidence that the information they receive is accurate, transparent, and not intentionally manipulated.
Artificial intelligence is a powerful technology that will continue to shape our society. Government has a responsibility to encourage innovation while also establishing reasonable safeguards against the misuse of emerging technologies.
This legislation does not prevent the responsible use of technology in political communication. Instead, it creates clear expectations that voters should know when they are viewing AI-generated content and provides protections against intentionally deceptive communications designed to interfere with the electoral process.
A healthy democracy depends on informed voters. I supported this legislation because it strengthens transparency, protects election integrity, and helps ensure that Massachusetts voters have the information they need to make decisions about the candidates and issues before them.
