What Problem Was This Bill Trying to Solve?

Patients seeking reproductive and gender-affirming health care services in Massachusetts face increasing threats from actions taken in other states and changes at the federal level. Some jurisdictions have attempted to restrict access to this care and pursue legal action against patients, providers, and organizations involved in providing services that are legal in Massachusetts.


Health care providers, patients, and advocates raised concerns about protecting personal medical information, preventing discrimination, and ensuring that Massachusetts providers can continue offering legally protected care without interference.


This legislation strengthens existing protections for patients and providers by safeguarding health care privacy, limiting cooperation with out-of-state investigations targeting legally protected care, and reinforcing Massachusetts’ commitment to allowing individuals to make their own health care decisions.


What Does the Bill Do?

  • Strengthens protections for individuals seeking reproductive and gender-affirming health care services in Massachusetts.

  • Limits state agencies and law enforcement from assisting other states or federal investigations targeting legally protected reproductive or transgender health care provided in Massachusetts.

  • Restricts businesses that manage electronic health information from sharing patient data connected to legally protected reproductive and gender-affirming health care.

  • Protects health care providers by:

    • Allowing certain prescriptions to be issued using the name of a health care practice rather than an individual provider. 

    • Excluding certain reproductive and gender-affirming medications from state prescription monitoring programs. 

    • Limiting third-party access to related medical records. 

  • Enhances license protections for health care professionals who provide or assist with legally protected reproductive and gender-affirming care.

  • Prevents insurance companies from discriminating against or penalizing providers who offer reproductive and gender-affirming health care.

  • Protects Massachusetts attorneys from discipline or removal for advising or representing clients regarding reproductive or gender-affirming care.

  • Prevents professional licensing boards from disciplining providers for providing legally protected care in Massachusetts or recording out-of-state legal actions related to that care.

  • Prohibits courts from considering claims of abuse, neglect, or maltreatment against parents or caregivers solely because they support a child seeking reproductive or transgender health care.

  • Requires acute care hospitals to provide stabilizing emergency health services, including abortion care when medically necessary, for patients requiring emergency treatment.

  • Builds upon previous Massachusetts protections established through the original Shield Act and the ROE Act.

Why I Voted This Way

Health care decisions are deeply personal decisions that should be made by patients in consultation with their trusted medical providers. Massachusetts has a responsibility to protect access to legally available health care and ensure that residents can receive care without fear of discrimination, intimidation, or unnecessary government interference.


This legislation provides important protections for patients, providers, and medical professionals by strengthening privacy safeguards, protecting health care workers who provide lawful care, and ensuring that Massachusetts laws reflect the values of patient choice and access to quality health care.


Protecting sensitive medical information is also essential in an increasingly digital health care system. Patients should be able to trust that their private health information will not be misused to target them for seeking lawful care.


I supported this legislation because it protects patient privacy, supports health care providers, preserves access to legally protected health services, and ensures Massachusetts continues to stand for individual health care decisions and equal protection under the law.
